Terms of Service
Effective August 1, 2026
These terms are an agreement between you and Shelf Collectibles LLC (“we”, “us”), who operate Shelf Collectibles at https://shelfcollectibles.com (the “Service”). By using the Service you accept them. If you do not accept them, do not use the Service.
1. What Shelf Collectibles is
Shelf Collectibles is a marketplace. Sellers are independent people and businesses who list, price, describe and ship their own items, often alongside a live stream on a third-party platform. We provide the venue, the auction and checkout mechanics, and payment processing through Stripe.
We are not the seller. The contract of sale for any item is between the buyer and that seller. We do not take possession of items, inspect them, verify their authenticity, or guarantee their condition or grading unless we expressly say so for a particular listing.
2. Your account
- You sign in through Privy, using an email code or a linked account such as Google, Apple, Twitch or X. Keep that method secure. Anyone who controls it controls your account.
- You must be at least 18, or the age of majority where you live, to buy or sell.
- One account per person, with accurate details. Shipping addresses must be real and yours.
- We may suspend or close an account that breaks these terms, that we reasonably believe is being used fraudulently, or that repeatedly fails to pay or ship.
3. Buying
Bids are binding
A bid is a commitment to buy at that price. You cannot retract it. Auctions may extend when a bid lands near the end (anti-sniping), may carry a reserve that must be met for the item to sell, and may offer a buy-now price that ends the auction immediately.
Winning an auction obliges you to pay promptly. Sellers may cancel and relist an unpaid win, and repeated non-payment may cost you your account.
Offers
Where a seller accepts offers, an accepted offer is a price you have committed to. Offers and counter-offers expire.
Checkout and stock
Starting checkout reserves the item for a limited period. If you do not complete payment in that window the reservation lapses and the item returns to sale. Being first to checkout is not the same as having bought it.
Payment
Payments are handled by Stripe. We never see or store your full card details. Prices are shown before you pay and include the item, shipping as calculated for your destination, the processing fee in section 5, and any tax we are required to collect.
4. Selling
Anyone with an account can open a shop. Before you can take money you must complete Stripe Connect onboarding, including the identity checks Stripe requires. Your use of Stripe is also governed by the Stripe Connected Account Agreement.
As a seller you are responsible for:
- Describing items accurately, including flaws, grading and whether an item is sealed.
- Holding the stock you list and having the right to sell it.
- Shipping promptly once paid, with tracking where offered, and honouring your stated rates.
- Your own taxes, business registration and any licences your jurisdiction requires.
- Responding to buyers, and to any chargeback raised against a sale of yours.
5. Fees
Sellers. Our standard commission is 3% of the item subtotal on each completed sale, taken automatically at checkout. Shipping charged to the buyer is not commissioned. We may agree a lower rate, or none at all, with an individual seller; if we have agreed one with you it applies from the moment we set it, and your seller dashboard shows the commission actually taken on every order.
Buyers. A processing fee of 2.9% + $0.30 is added to your order to cover the card processing on it. It is shown as its own line in your cart and again on the payment page before you pay, and it is included in any refund you receive.
Funds go to your connected Stripe account. New shops are on a longer payout schedule to begin with, money reaches your Stripe balance as soon as a sale completes, and moves on to your bank after a hold period. That hold shortens once your shop has a delivery history, and lengthens again while a chargeback is open against you. It exists because a chargeback is charged back to us first, and we can only pass it on while the funds are still reachable.
You can see your current payout schedule in your shop's Stripe dashboard at any time.
If we change our fees we will give notice before the change applies.
6. Returns, refunds and chargebacks
Refunds are issued through Stripe to the original payment method, in whole or in part, by the seller or by us. A refunded sale returns our commission too.
A refund goes back the way the payment came. A card payment refunds to that card, and a stablecoin payment refunds as stablecoin to the wallet address it was paid from. We cannot refund a stablecoin payment to a card or to a bank account.
Sellers set their own return policy, subject to any consumer rights you have by law, which these terms do not remove.
Chargebacks are a card network process, so this section applies to card payments. A stablecoin payment cannot be charged back.
If a buyer disputes a charge with their bank, the seller must supply evidence within the deadline the card network sets. A dispute that is not answered is lost automatically, so we will tell you as soon as one is raised, with the amount, the reason given, and the date evidence is due.
Chargebacks are the seller's to bear. Where a dispute is lost on a sale of yours we recover the disputed amount and any dispute fee from you, including from your balance and your future payouts. This applies whatever the buyer's stated reason, including a claim that the card was used without permission. We are stating that plainly because it is a real risk of selling, and because our commission is not large enough to absorb it on your behalf.
What we can do is help you win. Ship promptly, always add tracking, and ship only to the address on the order. A dispute answered with delivery evidence to the verified address is one the card network frequently decides in the seller's favour.
7. Giveaways
Sellers may run giveaways. The seller running one is solely responsible for it: the rules, the eligibility, the draw and the delivery of any prize, and for complying with the lottery and sweepstakes law that applies to them. No purchase is required to enter unless the seller says so and it is lawful where they are.
8. What you may not list or do
- Counterfeit, replica or unlawfully reproduced goods, or stolen property.
- Anything you cannot legally sell or ship, including regulated and hazardous goods.
- Bidding on your own listings, or arranging for others to, to inflate a price.
- Taking transactions off the platform to avoid fees.
- Scraping, overloading, probing or reverse-engineering the Service.
- Harassment, impersonation, or posting someone else's private information.
9. Content you post
You keep ownership of the photos, descriptions and other content you upload. You grant us a non-exclusive, worldwide, royalty-free licence to host, display and reproduce it for the purpose of operating and promoting the Service. You confirm you have the rights to everything you upload. We may remove content that breaks these terms.
10. Reviews
Reviews may only be left by buyers who actually bought from that shop, and must be honest. We do not remove reviews for being negative. We do remove ones that are abusive, off-topic, or posted to manipulate a rating.
11. Third-party services and streams
Shop pages may embed a seller's live stream from Twitch, YouTube, TikTok, Kick or similar. Those platforms are not ours, we do not control what is broadcast on them, and their terms and privacy policies apply to your use of them.
12. Availability
We aim to keep the Service running but do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue features. Live auctions in particular depend on network conditions we do not control; where a technical fault materially affects an auction we may void or re-run it.
13. Disclaimers
The Service is provided “as is”. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We make no warranty about items sold by sellers.
14. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability arising out of the Service is limited to the greater of the fees you paid us in the twelve months before the claim, or one hundred US dollars.
Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
15. Disputes between users
Disagreements about an item, its condition or its delivery are between the buyer and the seller. We may help, and may refund or reverse a payment where our records support it, but we are not obliged to arbitrate and we are not a party to the sale.
16. Indemnity
You agree to indemnify us against claims, losses and reasonable legal costs arising from your use of the Service, the items you sell, the content you post, or your breach of these terms.
17. Changes
We may update these terms. Material changes will be announced on the Service before they take effect. Continuing to use the Service after that means you accept the updated terms.
18. Governing law
These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law rules. Disputes will be heard in the state and federal courts located in New Jersey, and you consent to their jurisdiction.
